Terms and conditions of sale

1. Who is selling

The data controller is Luigi Pesaro, trading as Fungo Da Te — Az. Agr. Pesaro Luigi, VAT no. 01445770777, Italian tax code PSRLGU03E23G786N, registered at Via Santa Croce 2, 75025 Policoro (MT), Italia ("the Controller", "we"). For any request about your personal data you can write to info@fungodate.com or, via certified email (PEC), to luigi.pesaroazagr@pec.it.

2. Products and availability

The products for sale are described on their respective product pages. Images are indicative: since the kit is a living agricultural product, small natural variations between one unit and another are normal and do not constitute a defect. Availability is as shown at the time of the order and may vary based on stock.

3. Prices and payment

Prices shown on the site are in euros unless otherwise indicated. Checkout is handled through the Shopify platform; the payment methods accepted are those shown at checkout at the time of your order.

4. Formation of the contract

The contract is considered concluded when you receive our order confirmation email. If a product turns out to be unavailable after the order, we will contact you to arrange a refund or a substitute product, according to your preference.

5. Right of withdrawal

If you are buying as a consumer (a private individual purchasing for purposes unrelated to a trade, business or profession), you have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason, under Arts. 52–59 of the Italian Consumer Code (Legislative Decree 206/2005) — provided the kit's packaging is still sealed and the growing process has not been started.

Once the packaging is opened or the growing process is started, the right of withdrawal can no longer be exercised under Art. 59, letter e), of the Italian Consumer Code: the living substrate (the inoculated "block"), once opened, can no longer be returned and resold for hygiene reasons linked to the biological nature of the product. As stated in the Growing Guide, the sealed block keeps until the date printed on the pack: you can therefore decide calmly, within the 14 days, whether to start growing or return the kit still sealed.

To exercise withdrawal, within 14 days of receipt and with the kit still sealed, use the digital withdrawal tool at fungodate.com/recesso — no need to state a reason, and you'll get an immediate on-screen and emailed confirmation with the date and time of your request. You can alternatively write to us at info@fungodate.com with an explicit statement of your decision (stating your order number and product), or use the standard withdrawal form below. You must return the product within 14 days of communicating your withdrawal, intact and sealed; the cost and responsibility of the return shipment are always yours. The refund will be made within 14 days of receiving the return (or proof of shipment), using the same payment method used for the purchase.

6. Legal guarantee of conformity

If you are buying as a consumer, the products are covered by the 2-year legal guarantee of conformity from delivery, under Arts. 128–135 of the Italian Consumer Code. In the event of a lack of conformity you are entitled, depending on the case, to repair, replacement, a price reduction or termination of the contract. To claim under the guarantee, write to info@fungodate.com describing the problem, ideally with a photo.

7. Delivery

8. Complaints and dispute resolution

For any complaint you can write to us directly at info@fungodate.com: we always try to resolve things amicably. Alternatively, if you are a consumer resident in the EU, you can turn to the alternative dispute resolution (ADR) bodies competent in your country, as provided by the Italian Consumer Code.

9. Governing law and jurisdiction

The contract is governed by Italian law. If you are buying as a consumer, the consumer's forum (the court of the place where you reside or have elected domicile) still applies, under the Italian Consumer Code, and any more favourable provisions under the law of your country of residence, if different from Italy, remain unaffected.

10. Changes to these terms

We may update these terms over time. The applicable version is the one published at the time of your order. Last updated: 26 August 2026.
